Now true, martial law aint exactly mentioned in the Constitution, but the suspension of habeas corpus is in Article 1, Section 9, and the activation of the militia in time of rebellion or invasion is in Article 1, Section 8. Article 1, Section 9 states, "The privilege of the Writ of Habeas Corpus shall not be suspended, unless when in Cases of Rebellion or Invasion the public Safety may require it." Habeas corpus basically says that a person may not be held by the government without a valid reason for being held.
